These Terms and Conditions set out the rules for the provision of electronic services and for sales conducted via the online store www.sklepkarisma.pl (the “Store”).
The Store is operated by “KARISMA” Spółka z ograniczoną odpowiedzialnością (limited liability company) with its registered office at ul. Zegrzyńska 28A, unit 12, 05-110 Jabłonna, Poland; entered in the National Court Register (KRS) under no. 0000112521, NIP (Tax ID): 5240303671, REGON: 011094018, BDO: 000512545; share capital: PLN 150,000.00 (the “Seller”).

These Terms are continuously available on the Store website in a manner allowing downloading, recording and printing.
Using electronic services may involve typical Internet risks (e.g., malware, unauthorized access). Users are advised to use up-to-date antivirus software and a firewall.
Business Days – Monday to Friday, excluding public holidays in Poland.
Customer – a natural person (including a sole trader), legal person, or organizational unit with legal capacity who places an Order or uses Store services.
Consumer – a consumer as defined in Article 22¹ of the Polish Civil Code.
Entrepreneur – an entrepreneur as defined in Article 43¹ of the Polish Civil Code.
Account – a section of the Store assigned to the Customer enabling specific functions.
Goods – products presented in the Store.
Sales Agreement – a sales agreement for Goods concluded between the Seller and the Customer in accordance with the Civil Code.
Services – electronic services within the meaning of the Act of 18 July 2002 on the provision of electronic services.
Consumer Rights Act – the Polish Act of 30 May 2014 on consumer rights.
Order – the Customer’s declaration of intent aimed at concluding a Sales Agreement, specifying in particular the type and quantity of Goods.
Minimum technical requirements:
a computer/mobile device with Internet access;
access to e-mail;
a current web browser (e.g., Chrome, Firefox, Safari, Opera, Edge);
enabled cookies and JavaScript.
Any action that allows the Customer to view Store content constitutes use of the Store.
The Customer undertakes to:
refrain from providing unlawful content;
use the Store in a manner that does not disrupt its operation;
refrain from sending spam;
respect the rights of other Customers and the Seller;
use Store content for personal use only;
comply with applicable Polish law, these Terms, and general Internet etiquette.
The Seller provides free electronic services via the Store 24/7, including Account maintenance.
Account registration is completed via a registration form. The Account agreement is concluded for an indefinite period and may be terminated by requesting Account deletion or using the “Delete Account” function.
The Seller may organize contests and promotions; detailed rules are published in the Store. Unless stated otherwise, promotions do not combine.
In case of a breach of these Terms, after an ineffective request to cease the breach, the Seller may terminate the electronic services agreement with 14 days’ notice.
Information about Goods (descriptions, parameters, prices) constitutes an invitation to conclude an agreement within the meaning of Article 71 of the Civil Code.
All Goods offered in the Store are brand new and lawfully placed on the Polish market.
Placing an Order requires an active e-mail address.
Submitting an Order via the Store form constitutes the Customer’s offer. A Sales Agreement is concluded when the Customer receives an e-mail confirming acceptance of the Order for processing.
Sales Agreements are concluded in Polish or English, in accordance with these Terms.
Delivery is made to the address indicated by the Customer when placing the Order.
Available delivery methods: courier, parcel locker (Paczkomat), personal collection (if available).
At the ordering stage the Seller informs the Customer about the lead time (Business Days) and delivery charges.
The delivery time is calculated in Business Days as per Section VII(2).
Proof of purchase is provided with the shipment.
If an Order includes Goods with different lead times, the longest indicated time applies to the entire Order.
Prices are quoted in Polish zloty (PLN) and include VAT and all applicable charges.
Available payment methods:
bank transfer to the Seller’s account (order processed after payment is booked);
cash on personal collection (if available);
cash on delivery (COD) to the courier;
electronic payments (order processed after authorization from the payment operator).
The Seller informs the Customer of the payment deadline. Failure to pay on time, after an ineffective reminder with a grace period, entitles the Seller to withdraw from the agreement pursuant to Article 491 of the Civil Code.
A Consumer may withdraw from the agreement within 14 days without giving reasons by submitting a withdrawal statement; sending the statement before expiry of the period is sufficient.
The period runs from delivery of the Goods (or from conclusion of the service agreement).
The Seller will confirm receipt of the withdrawal statement by e-mail.
Exclusions from the right of withdrawal include, among others:
full performance of a service with the Consumer’s prior explicit consent;
goods or services subject to price fluctuations on financial markets;
non-prefabricated Goods made to the Consumer’s specifications or serving to meet their individualized needs;
perishable Goods or Goods with a short shelf life;
sealed Goods which are not suitable for return due to health protection or hygiene reasons if unsealed after delivery;
Goods which, after delivery, are inseparably mixed with other items;
sealed audio/video recordings or computer software unsealed after delivery;
supply of newspapers, periodicals or magazines (except subscriptions);
accommodation, transport of goods, car rental, catering, leisure or event services with a specific date/period;
digital content not supplied on a tangible medium, where performance began with the Consumer’s prior consent.
Upon withdrawal, the agreement is deemed not concluded. The parties must return what they received without undue delay and no later than 14 days. Goods must be returned to the Seller’s address.
The Seller refunds all payments received from the Consumer (including the least expensive standard delivery) within 14 days of receiving the withdrawal statement, subject to the right to withhold the refund until receiving the Goods or proof of dispatch.
If the Consumer chose a delivery method more expensive than the least expensive standard delivery, the Seller is not obliged to refund the difference.
The Consumer bears the direct cost of returning the Goods unless the Seller agrees otherwise.

Exchange is possible only for Goods currently available in the Store.
Procedure: complete the exchange form, securely pack the Goods, attach proof of purchase, and send via a trackable shipment. The Customer covers the cost of returning the Goods to the Store and shipping the new Goods.
If the selected Goods are unavailable, the Seller will contact the Customer to choose an alternative or cancel the exchange (in which case the original Goods are returned at the Customer’s expense).
Price differences:
lower price – refund of the difference within 14 days using the original payment method;
higher price – exchange after payment of the difference (a transfer confirmation may be included to speed up processing).
Personalized or custom-made Goods are not eligible for exchange.
Only unused, undamaged Goods are eligible; otherwise, the Seller may refuse the exchange.
The Seller supplies Goods free from defects and is liable to Consumers under Articles 556–576 of the Civil Code (statutory warranty for defects).

To process a complaint, the Customer should deliver/ship the Goods complained about (with proof of purchase, if possible) to the above address.
Complaints are reviewed within 14 days.
If the complaint is incomplete, the Seller will request supplementation within 7 days from receipt of the request.
Complaints regarding Store operation may be submitted in writing to the Seller’s address, by e-mail reklamacje@karismapoland.com, or by phone.
The complaint should include the Customer’s name, correspondence address, and a description of the issue.
Complaints are reviewed within 14 days; if not possible, the Customer will be informed of the expected review date. Missing data must be supplemented within 7 days of receipt of the request.
A Consumer may use, among others:
the permanent consumer arbitration courts at the Trade Inspection;
mediation conducted by the provincial inspector of the Trade Inspection;
free assistance from the municipal/poviat consumer ombudsman or consumer organizations (Federation of Consumers – helpline 800 007 707; Association of Polish Consumers – porady@dlakonsumentow.pl);
the EU ODR platform: http://ec.europa.eu/consumers/odr/.
Customers’ personal data are processed in accordance with applicable law and the Privacy Policy available on the Store website.
All rights to the Store (including economic copyrights, IP rights to its name, domain, website, forms and logos) belong to the Seller. Use is permitted only as provided by law and these Terms.
Provisions regarding withdrawal and complaints applicable to Consumers also apply to a natural person concluding an agreement directly related to their business activity, when the content of the agreement shows that it does not have a professional character for that person (as per CEIDG). Provisions on out-of-court dispute resolution do notapply to this category.
Disputes with Consumers are resolved by competent courts in accordance with the Polish Code of Civil Procedure. Disputes with Entrepreneurs are submitted to the court competent for the Seller’s registered office.
Matters not regulated herein are governed by the Polish Civil Code, the Act on the provision of electronic services, the Consumer Rights Act, and other applicable Polish laws.
The Seller will inform Customers of any changes to these Terms on the Store homepage together with a summary of changes and the effective date. Customers with Accounts will also be notified by e-mail. Changes take effect no earlier than 14 days from publication. A Customer who does not accept the new Terms may notify the Seller within 14 days of being informed; such notice results in termination of the electronic services agreement (Account).
